“We need a jingle”, Contest
Winner of contest will receive a two year lease on a 2007 Versa at no charge. Lease has no cash value. It is not transferable and will be the only prize given. Winner agrees to provide his or her own insurance on the winning prize vehicle, and agrees to comply with all kilometre restriction as well as maintenance schedule on the before mentioned vehicle.

Official Rules & Regulations

Participation in the 'We need a Jingle Contest'  (the "Contest") constitutes the entrant's full and unconditional agreement and acceptance of these Official Rules & Regulations including the decisions of 401-Dixie Nissan Ltd. (“401 Dixie”) which are final on all matters relating to the Contest.  These Contest Rules and Regulation can be found at www.401dixienissan.comThe Contest is void where prohibited by law.

By registering for the Contest you agree and accept the following rules and regulations:

1. Basics of the Contest - The Contest is sponsored and administered by 401-Dixie. The contest is a unique Internet promotion catering to all current 401-Dixie website users and all future and potential 401-Dixie website users resident in Ontario, Canada (excluding residents of other provinces including the province of Quebec) subject to the terms and conditions stated below.

ALL ENTRIES (the “JINGLE”) MUST BE ORIGINAL AND SUBMITTED BY THE AUTHOR AND CREATOR OF THE JINGLE.  YOU AGREE THAT YOUR JINGLE IS AN ORIGINAL WORK AND DOES NOT INFRINGE ANY INTELLECTUAL PROPERTY RIGHT OF ANY THIRD PARTY.  BY SUBMITTING THE ENTRY YOU ASSIGN YOUR INTELLECTUAL PROPERTY RIGHTS TO THE JINGLE TO 401-DIXIE AND YOU AGREE TO WAIVE ANY MORAL RIGHTS YOU MAY HAVE TO THE JINGLE.  YOU AGREE TO INDEMNIFY 401-DIXIE AND ITS EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS, AGENTS, REPRESENTATIVES OF 401-DIXIE, THEIR PARENT COMPANIES, AFFILIATES, SUBSIDIARIES, ADVERTISING, PROMOTION, FULFILLMENT AGENCIES AND LEGAL ADVISORS FOR ANY LOSSES, SUITS, CLAIMS OR ACTIONS RELATING TO YOUR JINGLE.

No purchase is necessary to enter or win. Maximum two contest registration per person. More than two contest registrations will invalidate all entries made by you. Once entered in the Contest, you are automatically entered into and eligible to win the 2007 Nissan Versa, Model code B5LG77, Option code BN00, Colour code K36, 2 year lease ._The winner of “We need a jingle contest” will be determined on a percentage basis. 50 percent of the contest will be determined by on-line voting. The top 10 contestants with appropriate-Jingles, which have the most original votes, will be considered for the final judging by the 401-Dixie judging committee. The winner will be announced on Thursday Dec. 20^th 2006 at a gala event. This gala will take place at 401-Dixie Nissan Ltd.   The Contest begins on October 4^th 2006 at 9:00am EST, and ends on December 1^st 2006 6pm EST. 401-Dixie Nissan reserves the right to make changes at any time without notice.

When entering the Contest, you grant 401-Dixie permission to send you additional promotional materials. Consequently, you have the opportunity to be first in line to receive new and up-to-date information on promotions or events.

2. Who Can Play - "We need a jingle contest” is open to persons who are over 18 years of age and are residents of the province of Ontario, Canada (excluding residents of the other provinces including the province of Quebec), have Internet access, a valid email account for the duration of the Contest after entry, who have a valid driver’s license and who can legally agree and accept the terms and conditions of the 401-Dixie lease applicable to automobile being won. Employees of 401-Dixie, their affiliates and agents, participating sponsors, contractors and immediate family members (defined as parents, children, siblings and spouse) of each such employee, together with those with whom such employees are domiciled are not eligible.  Who can vote – Anyone with a valid e-mail address. Only one vote is allowed per Jingle, per e-mail. To avoid unfair voting; Once the voting public had voted on a particular Jingle from an e-mail address, no other vote can be given to the same Jingle from that e-mail address. Use your vote wisely.

3. How to Enter - To enter the Contest, write an original jingle for 401-Dixie  that the dealership can use in all or any advertising and promotions. Your jingle must be in the following video/audio formats MOV, AVI, WMV, MP3 files OR Dvd, vhs format that can be dropped off at 401-Dixie Nissan and shall not be longer than 10 seconds. Once your jingle is complete, access the Contest web site at www.401dixienissan.com/contest , complete the online entry, accept and agree to these rules and regulations and follow the on-screen instructions and upload your MOV, AVI, WMV, MP3 files (only) in its entirety and click on the submit button. To enter, you must have a web browser that is compatible with Netscape 4.0 or higher; Internet Explorer 5.0; or a web browser compatible with the above-referenced browsers. Contestants who do not have internet access can submit their Jingle entries on a VHS or DVD format, with proper name and address and shall not be any longer than 10 seconds. Eligible entries will be uploaded to our contest website.

In the event of a dispute as to who submitted an online entry, the entry shall be deemed submitted by the "authorized email account holder". Entries will be declared made by the authorized email account holder of the email address at the time of entry. "Authorized email account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, on-line service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address.

4. Contest Dates - The Contest begins at 09:00:00 am EST on October 4th, 2006 and ends at 06:00 pm EST on Dec 1^st 2006 (the "Contest End Date").

5. What Can I Win –_2007 Nissan Versa, Model code B5LG77, Option code BN00, Color code k36, 2 year lease

The only Prize is as follows: ___2007 Nissan Versa, Model code B5LG77, Option code BN00, Colour code k36, 2 year lease will be determined by:  The winner of “We need a jingle contest” will be determined on a percentage basis. 50 percent of the contest will be determined by on-line voting. The top 10 contestants with appropriate-Jingles, that have the most original votes will be considered for the final judging by 401-Dixie Nissan Ltd. judging committee. The approximate value of the prize is $11,832.00  Canadian Dollars. No substitution or transfer of prize is permitted except by 401-Dixie , who, in its sole discretion and in the event of prize unavailability or any other reason, reserves the right to substitute any prize with another prize of equal or greater value. All taxes, fees, insurance and all other expenses and surcharges on prizes are the sole responsibility of the prize winners. Acceptance of a prize constitutes permission for 401-Dixieand its agencies to use the prize winner's name and likeness for advertising and promotional purposes in any media without additional compensation unless prohibited by law. 401-Dixie . will not nor does it make any representations or warranties, including, without limitation, implied warranties of merchantable quality and fitness of any awarded product or prize.

6. Notification and Redemption - If your jingle is chosen the winner, you will be notified via email. You must provide proof of identity, within seventy-two (72) hours of notification, or the prize will be forfeited.  You must agree to and accept the terms and conditions of 401-Dixie lease applicable to the winning automobile.  Prior to any prize being awarded the winner will be required to correctly answer, unaided and without mechanical or electronic assistance, a mathematical skill testing question.

401-Dixie is not responsible, whether as a result of human error or otherwise, for any failure to contact any selected entrant, so please make sure the information you provide is up-to-date, accurate and current.  401-Dixie assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction to or unauthorized alteration of entries.

If the selected winner is unable to answer the skill testing question within 10 minutes, cannot be reached via email within 24 hours, does not otherwise meet all Contest rules and regulations or if the winning jingle and its related images, music or lyrics are found not to be original or are found to be copied, fraudulent or a forgery the prize will go to the next jingle selected by 401-Dixie that complies with these conditions.

In order to claim a prize, winners must sign and return to 401-Dixie a standard declaration of compliance with the contest rules and release form releasing 401-Dixie Nissan and each of their respective affiliates, subsidiaries, directors, officers, employees, agents and advertising and promotional agencies from and against any and all liability arising from the acceptance and use of any prize.

7. Contest Deadlines - To be eligible for the ‘We need a jingle contest” jingles must be must be accepted, received and downloaded by no later than 06:00:00pmEST on_Dec. 1^st 2006.

8. Chances of Winning - The chances of winning depend on the total number of entries and the total number of eligible votes received and the final decision of 401-Dixie Nissan Ltd. judging committee on or before the Contest Closing Date.

The names and photographs of the prize winners may be published on 401-Dixie  website or any media as determined by 401-Dixie  within 10 days of the close of the contest, subject to verification.

9. Privacy – 401-Dixie may collect personal data about you for the administration of the Contest and for purposes of market research. We use this information to provide entrants with up to date information about 401-Dixie. No such personal data will be transferred or sold to any third party except in the following circumstances:

• When you give 401-Dixie  permission to do so;
• When in good faith we believe the law requires it;
• Under limited circumstances specifically described to you when we collect the information, such as in the rules of contests, sweepstakes or other promotions;
• To our respective agents for data processing purposes, our respective professional advisors and promotional and marketing agencies. Our affiliated companies and their agents and advisors and their respective employees are restricted from using the information for any other purpose other than as described in these rules and regulations.

10. General Terms and Conditions - This Contest is subject to the laws of Province of Ontario and the Federal laws of Canada applicable therein.  You agree that any dispute or any action at law or in equity arising out of or relating to the Contest or these rules and regulations shall be filed only in the provincial or federal courts located in Toronto, Ontario, and you consent and submit to the personal jurisdiction of such courts to resolve any dispute relating to the Contest.

By participating in the Contest, each participant agrees to release and hold 401-Dixie and the employees, officers, directors, shareholders, agents, representatives of 401-Dixie, their parent companies, affiliates, subsidiaries, advertising, promotion, fulfillment agencies and legal advisors, contractors, harmless from any and all losses, damages, rights, claims and actions of any kind in connection with the Contest or resulting from acceptance, possession, or use of any prize, including without limitation, any loss, personal injury, death, property damage, and claims based on publicity rights, defamation, or invasion of privacy.

All entries become the property of 401-Dixie and all decisions of the Contest organizers are final. 401-Dixie is not responsible for any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Contest or from downloading any material from 401-Dixie’s server or from any other Internet web site, regardless of whether the material was prepared by 401-Dixie or a third party.

401-Dixie  RESERVES THE RIGHT TO CANCEL OR MODIFY THE CONTEST IF FRAUD, TECHNICAL FAILURES INCLUDING ANY NETWORK, SERVER OR HARDWARE OR SOFTWARE FAILURE, EMAIL PROBLEMS OR FAILURE OR INTERNET CONGESTION OR ANY OTHER FACTOR BEYOND 401-Dixie’s  REASONABLE CONTROL IMPAIRS THE INTEGRITY OF THE CONTEST AS DETERMINED BY 401-Dixie Nissan IN ITS SOLE DISCRETION. 401-Dixie is not responsible for any technical, hardware, software or telephone failures of any kind, lost or unavailable network connections, or failed, incomplete, garbled or deleted computer or network transmissions or entries that are stolen, misdirected, lost, late, damaged or ineligible, which may limit the ability to participate in the contest.

11. Restrictions - The following are prohibited and will result in automatic, permanent expulsion from the Contest: (1) Entering We need a jingle contest under more than one email address at a time; (2) Entering the contest more than once; (3) Viewing or tampering with the 401-Dixie system or voting procedures, or its source code or data; (4) Using any method that artificially increases odds of winning; (5) Non-compliance with or breach of these rules and regulations of the Contest; and (7) Any other act which 401-Dixie Nissan Ltd. determines in their sole discretion jeopardizes the integrity of the contest.
